Lexis 3118 (Dec. 20, 2004), On Pending PCRA Petition that Robert R. Bryan submitted on 2/15/05 to the Pennsylvania Court of Common Pleas, Philadelphia. This was filed in response to the request of Philadelphia Common Court Please Judge Pamela Dembe, who expresssed her view that a recent Pennsylvania Supreme Court decision in the Johnson case prohibited her from holding a hearing on two important issues that Mumia's previous attorneys had requested. These were: 1) The affadavit of Ronald Pates affirming that his half-sister Priscilla Durham admitted to him that she had lied when she stated in court that Miumia had confesssed to the murder of Officer Daniel Faulkner. 2) The affadavit of Yvette Williams who affirmed that Cynthia White told her that she was not present at the murder scene and lied in court when she identified Mumia as being there. White was the prosecution's chief "eyewitness" at the 1982 trial. Judge Dembe will now consider Robert Bryan's filings and the filings of the State of Pennsylvania to decide whether to hold any hearings on the above matters.
